Criminal & DUI Results

  • Secretary of State License Reinstatement Hearing. Client had 5 arrests for DUI and 3 Driving while license is Revoked. Restricted License Granted and in one year eligible for full reinstatement.

  • DUI Jury Trial - Client’s second arrest for DUI and was in an accident. The police stated client had slurred speech, bloodshot eyes and smelled of alcohol. The police provided evidence that client’s blood alcohol content was .32, however, the other driver testified that client did not appear to be drunk.On cross examination, the State’s expert stated”to have a blood alcohol level of .32 the effects on a person would be much more severe than those seen by the other driver in the car accident.” Jury found client not guilty.
  • DUI bench trial – Second DUI client was speeding and swerving. No breathalyzer and client failed Field Sobriety Tests (FST). The police had video in the squad car, however they had moved the car and therefore the tests performed by my client were not videotaped. Client found not guilty.
  • DUI bench trial – Client was traveling at an excessive rate of speed and spinning the tires on his car. He was stopped by police, where no breathalyzer was performed but the client failed Field Sobriety Tests (FST). The police had a video camera in their car and pulled up behind clients vehicle. When the officers spoke to my client the audio was turned off. When the officers had my client perform FST they had him perform them in front of the defendant’s vehicle out of sight of their camera, and was not recorded. Client found not guilty due to lack of evidence.
